What is H1B Regular Processing vs Premium Processing ?

Regular processing is normal processing done by USCIS. There is no deadline for USCIS to process your H1B petition. But, if you file your H1B in Premium Processing, then they will process the application within 15 Days. Currently, premium processing takes 15 calendar days, but from October, 2020, it will be 15 Working days or about 21 Calendar Days

What is estimated H1B Regular Processing Time ?

The H1B Regular processing time can range from few weeks to few months. It can be anywhere from 2 months to about 12 months. The processing time depends on many factors such as the Service Center that is processing the petition, if the petition is new cap subject, transfer or extension. So, depending on the conditions and USCIS load, it can be more or sometimes less

Does upgrading to H1B Premium Processing get more RFEs ?

No. It is a general perception that upgrading to premium processing will get more RFE. But, it is not true. If you are in need of faster response time, you need to uprade to premium processing

How much does it cost to upgrade to H1B premium processing?

To upgrade your H1B petition to premium processing, it will cost $1,440 USD

How much time does it take to get H1B Receipt Notice ?

After you submit H1B petition with USCIS, you would usually get the receipt notice in about 2 to 3 weeks. Due to mail delays, it may take about a month sometimes, but most of the times it will take about 2 weeks

What if my H1B case processing is taking longer and outside of USCIS processing times ?

If your H1B petition is taking longer than the given USCIS processing times for that petition category and in that service center, then you can raise a Service Request with USCIS. They publish the Service Request Date as well, as you can see in all the above tables. If your case was filed on or before the Service Request Date in above processing time, then you can raise a service request

Does Upgrading H1B to premium also upgrade H4 Processing to Premium ?

No, the preimum processing upgrade only is applicable to H1B application. H4 was processed in the past as premium as courtesy, but it is not applicable anymore. The reaosn is the biometrics requirements for H4.

What are the current procesisng times for H1B Transfer ?

Check the above tables by service center for the latest processing times for H1B transfer. It can range anywhere from 2 months to 6 months, if filed in regular procssing. If premium processing, it will be faster and in 15 days

What happens, if my premium processing request for H1B takes more than 15 days ?

USCIS would issue a refund for the H1B application, if the proessing time was not meeting the given timeline by them, which is 15 days. They will refund and also continue to preocess the same in premium processing

Are there any Delays to get H1B receipts with COVID-19 ?

Yes, there are dealys with getting H1B case receipts. It can take anywhere from 30 to 45 days or more. You shoudl call the service cetner or check with your attorney to follow up with USCIS.

Is USCIS Processing time for H1B slow due to COVID-19 ?

Not necessarily. There are some delays, but not terribly bad. USCIS is processing times in general for H1B regular processing is usually slow and can take few weeks to few months

Does USCIS Process faster, if I was laid of on H1B as grace period if 60 days ?

No, USCIS does not have any provisions to process H1B petitions for someone laid off and in grace period. They will take the same normal processig time. If you need faster response, you need to upgrade to premium processing

Can I work after 240 days after I-94 Expiration, with H1B case pending ?

There are two situations 1. Extension, 2. Transfer or Amendment. Firstly, if your H1B petition was filed as Extension, then you can only work upto 240 days. You cannot work after 240 days after expiration of your I-94. But, if you filed it as Transfer or Amendment, then you do not have the 240 days rule restriction, you can work even after 240 days
